Federal Court Orders Release of Abrego Garcia from ICE Custody

A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The situation originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his return to the United States to face alien smuggling allegations, he was held in federal detention.

In her order, the court pointed out that the authorities does not have a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The court challenge center on disputed assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.

He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in the state of Tennessee.

Conditions of Freedom

The judge, who was hearing his petition to removal in a federal court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This order effectively transfers his supervision to the Tennessee court.
